Equal Employment Opportunity Commission (EEOC)on Tuesday accused Walmart Inc of failing to put an end to severe sexual harassment of female workers by the manager of a West Virginia store and of firing a woman after she complained to the commission. Debra Lawrence, the EEOC's regional attorney in Philadelphia, said preventing sexual harassment requires employers to act "promptly and forcefully." Zeman, for example, claims X laid off 60% of workers who were 50 or older and nearly three-quarters of those who were over 60, compared with 54% of employees younger than 50. The judge dismissed a claim that X intentionally targeted older workers for layoffs, but gave Zeman a month to file an amended lawsuit fleshing out that claim. Export control laws restrict companies from sharing sensitive information and technology with certain individuals from other countries. Rebecca Bernhard, a Minneapolis-based labor lawyer who represents companies, said employers subject to export control laws often ignore the ban on citizenship-based bias in the federal Immigration and Nationality Act (INA), exposing them to legal action. Out of more than 10,000 hires, SpaceX only hired one asylee during that period, according to the lawsuit. The DOJ did not directly cite its guidance in the SpaceX lawsuit, but used nearly identical language to describe the company's alleged violations. Winsor, an appointee of Republican then-President Donald Trump, denied a bid by four Chinese nationals to block the law pending the outcome of their lawsuit filed in May. Florida's law prohibits individuals who are "domiciled" in China and are not U.S. citizens or green card holders from purchasing buildings or land in the state. The ACLU claims the law violates the U.S. Constitution's guarantees of equal protection and due process and the federal Fair Housing Act (FHA), which prohibits housing discrimination based on race and national origin. The Biden administration filed a brief last month agreeing that the Florida law violates the FHA.

Equal Employment Opportunity Commission (EEOC) involving a company's use of AI to make employment decisions. The commission, which enforces workplace bias laws, in 2021 launched an initiative to ensure that AI software used by U.S. employers complies with anti-discrimination laws. Many worker advocates and policymakers are concerned about the potential for existing biases to be baked into AI software, even unintentionally. Circuit Court of Appeals is the first from an appeals court involving a nationwide campaign that has seen workers at more than 300 Starbucks locations vote to unionize. "Fear of retaliation will exist unless the Memphis Seven, apparently terminated for their union support, are reinstated," Circuit Judge Danny Boggs wrote for the court. Starbucks and the labor board, which had sought the order reinstating the workers, did not immediately respond to requests for comment. More than 600 complaints have been filed with the labor board accusing Starbucks of illegal labor practices such as firing union supporters, spying on workers and closing stores during labor campaigns.

Adolph sued Uber in 2019, claiming the company misclassified UberEats drivers as independent contractors rather than employees, who must be reimbursed for work expenses under California law. A unique California law called the Private Attorney General Act, or PAGA, allows workers to sue for employment law violations on behalf of the state and keep one-quarter of any money they win. The California Supreme Court said nothing in that law bars workers from pursuing claims on their own behalf in arbitration while separately litigating large-scale claims in court. July 13 (Reuters) - A group of Republican U.S. state attorney generals on Thursday warned the country's largest companies that certain workforce diversity policies could be illegal in light of the U.S. Supreme Court's decision effectively striking down affirmative action in higher education. The attorney generals urged the companies to abandon race-based quotas or preferences in hiring, promotion and contracting and threatened legal action "sooner rather than later" if they do not. "Companies that engage in racial discrimination should and will face serious legal consequences," the attorney generals wrote. They were joined by the attorney generals of Indiana, South Carolina and Missouri, among others. But in Thursday's letter, the attorney generals said well-intentioned race discrimination is still illegal.

The seven-member California Supreme Court on Thursday unanimously ruled that allowing so-called "take home COVID" claims could encourage businesses to adopt precautions that slow the delivery of services to the public, or to shut down completely during pandemics. July 6 (Reuters) - Uber Technologies Inc (UBER.N), DoorDash Inc (DASH.N) and other app-based food delivery companies filed lawsuits on Thursday seeking to strike down New York City's novel law setting a minimum wage for drivers. The companies filed separate complaints in New York state court claiming the law, which takes effect next week, is based on a misunderstanding of how the food delivery industry works. Relay Delivery Inc also filed a lawsuit in the same court claiming the law will put the New York-based company out of business unless it raises the fees it charges to restaurants. The law will require that drivers be paid $17.96 an hour, which will rise to nearly $20 in April 2025. June 30 (Reuters) - The U.S. Supreme Court on Friday agreed to decide whether workers can bring discrimination lawsuits based on unwanted workplace transfers that were allegedly motivated by bias, an issue that can make or break many cases. Muldrow appealed a lower court's ruling that the conduct by the police department could not form the basis of a discrimination lawsuit. The Supreme Court will hear the case in its next term, which begins in October. The Supreme Court on Friday took no action on a separate case questioning whether paid suspensions count as adverse employment actions under Title VII of the Civil Rights Act of 1964. Circuit Court of Appeals said the law adopted last year by Westchester County, New York, was valid under a 2000 Supreme Court ruling that rejected a challenge to a similar law in Colorado. The court said it was bound to follow that ruling unless the Supreme Court expressly overturns it. The Supreme Court in a 2014 case struck down a Massachusetts law establishing a 35-foot buffer zone around abortion clinics, but the court did not mention the Hill decision. Last year, an Ohio-based U.S. appeals court temporarily blocked a Kentucky county's 10-foot buffer zone, citing the 2014 Supreme Court decision. A Philadelphia-based appeals court is currently considering a challenge to a 20-foot buffer zone adopted by Harrisburg, Pennsylvania.
